1. Contest Description: NO PURCHASE NECESSARY TO ENTER OR WIN. The 2011 APAC Creatives Behind the Lens Contest (“Contest”) is a skill contest in which entrants create and submit up to three previously unpublished photographs. The Contest begins on 1 August 2011 at 12:01 a.m. Hong Kong time and ends on 31 Aug 2011 at 11:59 p.m. Hong Kong time (the “Term”).
2. Eligibility: To be eligible to enter the Contest, you must:
(i) be an employee of an advertising agency, advertising/design firm or a publishing company and you must not be a professional photographer;
(ii) be a legal resident of one of the following territories: (a) China; (b) Hong Kong or Taiwan; or (c) Australia;
(iii) be 18 years or over at date of entry; and
(iv) be registered with Corbis and has a valid Corbis login name.
ONLY THREE ENTRIES PER ENTRANT. Employees and representatives of Corbis, its respective parents, affiliates, related companies, agents, subsidiaries, advertising and promotional agencies, any prize provider, and any entity involved in the development, production, implementation, administration or fulfillment of the Contest, and their immediate family members and persons living in the same household, are not eligible to participate or win.
Corbis reserves the sole right to verify eligibility and to adjudicate on any dispute at any time. Corbis’ adjudication on eligibility shall be final.
3. Sponsor: Corbis Hong Kong, Limited located at 19/F, Citicorp Centre, 18 Whitfield Road, Hong Kong is the sponsor of the Contest ("Sponsor").
4. How to Enter: NO PURCHASE NECESSARY. Eligible entrants may submit their previously unpublished photograph by visiting the Contest website located at www.creativesbehindthelens.com (“Website”) during the Term. To enter the Contest, you must register on the Website by providing the following information: your name, country/territory of residence, contact e-mail address, employer name, job title, work e-mail address, Corbis login name.
LIMIT: Only three (3) entries per Entrant. Subsequent entries (after the first three (3) entries) will not be returned or considered by Sponsor.
Entries should be submitted online (high res max. 2 MB)
Incomplete entries will not be accepted. Sponsor reserves the right, in its sole discretion, to remove from the Website and disqualify any entry not in compliance with these Official Rules.
5. Grant of Rights: By submitting an entry, you grant Sponsor the limited license to display your entry and to otherwise promote the Contest.
Further, by entering the Contest, you warrant and represent that your photograph is your own original work created by you, is true and verifiable, has not been previously published, has not won a previous prize or award; that you own or otherwise control all of the rights to your photograph (including, without limitation, the rights to any persons appearing in the photograph) and that your photograph does not violate any law, regulation or any right of any third-party, including but not limited to rights of copyright, publicity and privacy. Submitting a photograph that is copyrighted by another individual will make you responsible for any legal action the legal copyright holder might take against you or Corbis.
By entering the Contest, each entrant waives any and all rights he or she may have to the photograph including any so-called moral rights to demand that they are credited as the photographer whenever the image is reproduced and to complain and claim damages if the image is subjected to derogatory treatment.
Entries, including the photograph, may not defame or invade the rights of publicity or privacy of any person, living or deceased, or otherwise infringe upon a person's personal or proprietary rights. Photographs that are deemed by the judges in their sole discretion to be immoral, obscene, profane or not in keeping with Sponsor's image will be disqualified. Sponsor reserves the right in its sole discretion to disqualify any entry at any time which, in the Sponsor’s reasonable opinion, endangers the safety or well being of any person or in the event it is determined that the entrant has not complied with these Official Rules. Other than for winner notification, neither Sponsor, nor anyone acting on its behalf, will enter into any communication with any entrant regarding this Contest, nor will entries be acknowledged or returned.
6. Conditions of Entry: By entering the Contest, you agree to comply with these Official Rules, including all eligibility requirements. You agree to receive correspondence from Corbis for direct marketing purposes unless when you entered this Contest you opted out of receiving such correspondence by email, in which case you will not receive information online about our offers. Furthermore, by entering the Contest, you consent to the Sponsor's and its partner, affiliates and subsidiaries use of your name, except where prohibited by law, and use, reproduction, and display of your entry for any advertising and promotional purposes relating to the Contest, in any media now known or hereafter devised, without further notice, compensation, consideration, review, or consent and without regard to moral rights. Entrants further agree to comply with and be bound by decisions of Corbis, which shall be final in all respects.
Corbis reserves the right at its sole discretion to disqualify any individual it finds to be:
(i) violating these Official Rules or not eligible to enter this Contest;
(ii) tampering or attempting to tamper with the operation of the Contest or any Corbis Web site;
(iii) violating the conditions of service, conditions of use and/or general rules or guidelines of any Corbis property or service; or
(iv) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person.
Corbis also reserves the right to amend the terms and conditions governing this Contest from time to time at its sole discretion.
7. The Winners: Up to thirty (30) local winners (“Local Winners”) will be selected from entries submitted by entrants from each of the three (3) territories, i.e. (a) China; (b) Hong Kong and Taiwan; and (c) Australia.
Ten (10) regional winners (“Regional Winners”) will be selected from the Local Winners across the three (3) territories.
The names of the Winners will be posted on the Website, and will be available from 15 Sept to 31 December 2011.
8. The Prize: All winning entries will be showcased on the Website..
The works of the Regional Winners as well as a selection of the Local Winners’ works will be published by Corbis for distribution to interested parties within the industry.
Corbis may request high res photographs (up to 10 Mb) to be supplied by the Winners for showcasing purposes.
9. How to Win: Entries from each of the three (3) territories will first be evaluated by a panel of max. five (5) judges (“Local Judges”) who will be responsible in selecting the Local Winners.
The judges shall consist of creative industry professionals and professional photographers, as well as representatives from Corbis.
The Local Judges for a territory will select up to thirty (30) entrants with the highest score as Local Winners. All the Local Winners will be selected on or about 9 Sept 2011.
The photographs of all the Local Winners from all three (3) territories will then be evaluated by a panel made up of a max five (5) regional judges and ten (10) Regional Winners will be selected.
All Winners will be notified by Corbis on or about 19 Sept 2011. All Winners will be required to execute and return, within ten (10) days of issuance of notification, an affidavit of eligibility, release of liability, release of any third party displayed in the photograph and a publicity release (hereinafter “Affidavit and Release”). If Affidavit and Release are returned as non-deliverable, if a potential winner is found to be ineligible or not in compliance with these Official Rules, does not respond within the time period specified or cannot accept the terms and conditions of being a Local Winner, his/her entry will be disqualified from the Contest.
The Judges' decisions are final with respect to all aspects of the Contest. The Winners will be notified by e-mail. If the prize notification is returned as undeliverable, the Winner will be disqualified and an alternate winner will be selected based on the criteria for the selection of the winners described herein. If, in Sponsors' opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Contest, or if technical difficulties compromise the integrity of the Contest, the Sponsor reserves the right to terminate the Contest.
10. Limitations of Liability: By entering, entrants: (a) release and hold harmless Corbis, and its respective parents, subsidiaries, affiliates, directors, officers, employees, and agents from any and all liability for any injuries other than death or personal injury caused by negligence, loss or damage of any kind arising from or in connection with the Contest (including but not limited to the receipt, use or misuse of any prize or any component thereof). Corbis assumes no responsibility or liability for the following: (a) computer, online, telephone or technical malfunctions that may occur; (b) any incorrect or inaccurate information, whether caused by website users, any of the equipment or programming associated with or utilized in the Contest, or any technical or human error which may occur in the processing of submissions in the Contest; (c) any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries; (d) any problems, failures or technical malfunction of any telephone network or lines, computer online systems, servers, providers, computer equipment, software, email, players or browsers, on account of technical problems or traffic congestion on the Internet, at any website, or on account of any combination of the foregoing; (e) any injury or damage to participants or to any computer related to or resulting from participating or downloading materials in this Contest; or (f) any use or inability to use the prize awarded. If, for any reason, the Contest is not capable of running as planned, including because of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, force majeure, or any other cause beyond the control of Corbis which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, Corbis reserves the right to cancel, terminate, modify or suspend the Contest if continuing with it becomes impractical for reasons beyond its control.
11. Privacy: By entering the Contest, you acknowledge that you have already agreed to the conditions of Corbis’ privacy policy, which control this Contest. Furthermore, you consent to the collection, use and disclosure of your personal information for the purposes of administering this Contest in accordance with such privacy policy. Your personal information may be transferred to and processed within or outside of your country of residence, and the data protection laws of different jurisdictions vary.
Unless prohibited by law, by accepting a prize you consent to use Corbis’ use of your photograph, name, and/or domicile for promotion-related marketing purposes. If you so consent, for marketing purposes such as determining effective advertising media, devising contests and working with affiliated partners, Corbis may on occasion share certain information with our affiliated merchants or companies. You have the right to request access to and correction of your personal information held by Corbis and to be informed of Corbis’ policies and practices in relation to personal information and the kind of personal information held by us. If you wish to access or correct your personal information held by us, opt out of receiving further communications from us or our affiliated merchants or companies, or have other questions respecting our privacy policy, please contact us at service@corbis.com (please specify that the enquiry is related to “Creatives Behind the Lens APAC 2011”).
12. Disclaimer: While Corbis will take good care when printing of the photographs for showcasing purposes, Corbis cannot be held responsible if the printing quality is different from the quality expected by you.
13. Governing Law and Jurisdiction: The Contest and Official Rules are governed and interpreted by the laws of the Hong Kong Special Administrative Region of the PRC.
